Terms of Service

To use the Platform, you must:

• Be at least 18 years old, or have the legal capacity to enter into a binding agreement.
• Provide accurate and complete registration information.
• Use the Platform in compliance with applicable laws and regulations.

You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted through your account. You agree to:

• Provide accurate and up-to-date information.
• Maintain the security of your account.
• Notify us promptly of any unauthorised access or suspected security breach.
• Not share your login credentials with others.
• nipuneX is not responsible for losses resulting from your failure to protect your account credentials.

As a job seeker, you agree to:

• Provide truthful and accurate personal and professional information.
• Upload only documents that are yours or that you have permission to use.
• Keep your profile, CV, and application materials current.
• Apply only for genuine opportunities that match your qualifications.
• Communicate respectfully with employers and other users.

Employers, including authorised team members acting on behalf of a company, agree to:

• Publish genuine employment opportunities.
• Provide accurate company information.
• Comply with applicable employment, privacy, and anti-discrimination laws.
• Use candidate information only for legitimate recruitment purposes.
• Respect candidate privacy and confidentiality.

Employer accounts may include multiple team members with role-based permissions. The company account holder is responsible for invitations, access controls, and actions taken by authorised users on the Platform.

nipuneX uses artificial intelligence to support recruitment workflows. Depending on your role and settings, AI features may include job and candidate matching, ranking and recommendations, keyword suggestions, cover letter assistance, company summaries, onboarding suggestions, dashboard insights, and voice CV transcription.

• Some AI features, including Smart Ranking, are optional and may require explicit enablement in account or team settings.
• AI processing may use secure cloud services, including Amazon Bedrock and AWS Transcribe.
• AI-generated outputs are provided for assistance only and may be incomplete or inaccurate.
• Employers remain solely responsible for recruitment decisions.
• Users should review AI-generated content before relying on it.

nipuneX uses secure authentication technologies, including Amazon Cognito. You may also sign in using supported third-party identity providers such as Google, LinkedIn, or GitHub, where available.

• You are responsible for protecting your login credentials.
• You are responsible for activity carried out through your account, including through connected sign-in providers.

The Platform may provide messaging and recruitment communication features, including direct messages, interview invitations, attachments, application discussions, notifications, and related workflow updates.

• Users must communicate professionally and respectfully.
• Harassment, discrimination, threats, spam, phishing, and abusive behaviour are prohibited.

Job seekers can manage how profile information is shared through privacy and visibility settings. Depending on your choices, you may control recruiter visibility, company searchability, contact preferences, and which profile fields are shown.

• When you apply for a position, relevant profile and application information is shared with the employer responsible for that vacancy.
• Additional details about how we collect and use personal data are set out in our Privacy Policy.

Users must not:

• Publish false or misleading information.
• Attempt unauthorised access to the Platform or its systems.
• Upload malware or harmful software.
• Use bots, scrapers, or automated tools without authorisation.
• Interfere with platform security or performance.
• Collect personal information for purposes unrelated to recruitment.
• Infringe the intellectual property or other rights of others.

nipuneX may investigate suspected misuse and take appropriate action, including content removal, suspension, or termination.

All software, logos, trademarks, graphics, text, databases, and other Platform content are owned by or licensed to nipuneX and are protected by applicable intellectual property laws.

• You retain ownership of content you upload.
• By uploading content, you grant us a non-exclusive, worldwide, royalty-free licence to host, process, display, and use that content solely to operate, improve, and provide the Platform.

The Platform may integrate with third-party providers, including cloud infrastructure, authentication services, payment processors, analytics tools, and communication services.

• We are not responsible for the availability, content, or privacy practices of third-party services.
• Your use of those services may also be governed by their own terms and privacy policies.

The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we do not warrant that:

• The Platform will be uninterrupted or error-free.
• Every vacancy is genuine or will remain available.
• Every candidate profile is accurate or complete.
• Employers will respond to applications.
• Candidates will receive interviews or offers.
• Recruitment outcomes depend on many factors outside our control.

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from:

• Use of the Platform.
• Recruitment decisions or employment outcomes.
• User-generated content.
• Service interruptions.
• Unauthorised access to user accounts.
• Technical failures beyond our reasonable control.

Our total liability shall not exceed the amount paid by you to us for paid services during the twelve (12) months preceding the event giving rise to the claim.

We may suspend or terminate accounts that:

• Violate these Terms.
• Provide false or misleading information.
• Engage in fraudulent or unlawful conduct.
• Threaten platform security.
• Misuse user information.
• Harm other users or the reputation of the Platform.

Termination does not relieve users of outstanding legal or financial obligations.

These Terms are governed by the laws of the Democratic Socialist Republic of Sri Lanka. Any dispute arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the competent courts of Sri Lanka, unless otherwise required by applicable law.

We may revise these Terms to reflect changes in our services, legal requirements, or business operations. Updated Terms will be published on the Platform with a revised effective date. Continued use after publication constitutes acceptance of the updated Terms.
